Strengthening the implementation plan of the reform of the supervision and utilization and disposal capacity of hazardous waste


This plan is formulated to implement the decision-making and deployment of the CPC Central Committee and the State Council, implement laws and regulations such as the law of the people's Republic of China on the prevention and control of solid waste pollution and environment, improve the capacity of supervision and utilization and disposal of hazardous waste, and effectively prevent and control the environmental and safety risks of hazardous wastes.

1、 General requirements

(1) Guiding ideology. Guided by Xi Jinping's socialist ideology with Chinese characteristics in the new era, we carried out the spirit of China's nineteen and nineteen second, third, fourth and fifth plenary sessions of the party in an all-round way, thoroughly implemented Xi Jinping's ecological civilization thought, and insisted on precise pollution control, scientific pollution control and pollution control according to the requirements of the Central Committee and the State Council's decision making deployment and the national ecological environment protection conference. Taking continuous improvement of ecological environment quality as the core, taking effective prevention and control of hazardous waste environment and safety risk as the goal, deepening institutional and mechanism reform, focusing on improving the capacity of hazardous waste supervision and utilization and disposal, and effectively maintaining the health and ecological environment safety of the people.

(2) Working principles.

——We will adhere to reform and innovation and strive to stimulate vitality. We will comprehensively deepen reform, innovate methods and methods, stimulate market vitality, encourage qualified areas to try first, and effectively solve outstanding problems in the supervision and utilization of hazardous waste.

——We will adhere to the rule of law and strengthen supervision. We will improve the relevant laws and regulations and standards for hazardous waste, clarify the division of responsibilities of departments, establish and improve the linkage mechanism of departments and improve the supervision system of hazardous waste.

——We will make up the short board by adhering to the overall arrangement. Through scientific evaluation, reasonable layout and optimization of structure, the short boards of medical waste and hazardous waste collection and treatment facilities shall be supplemented in different industries and regions.

——We will adhere to multiple governance and focus on risk prevention and control. We will strengthen the guidance and support of the government, compact the responsibility of the main body of enterprises, give full play to the role of social organizations and public supervision, implement joint prevention, joint control and joint governance, and strictly abide by the bottom line of hazardous waste environment and safety risk.

(3) Work objectives. By the end of 2022, the regulatory system and mechanism of hazardous waste will be further improved, and the linkage mechanism between safety supervision and environmental supervision will be established; The high incidence of illegal transfer and dumping of hazardous waste has been effectively curbed. The short board of medical waste and hazardous waste collection and treatment facilities is basically completed. The harmless disposal rate of medical waste in urban built-up areas above county level has reached more than 99%. The disposal capacity of hazardous waste in each province (autonomous region and municipality directly under the central government) basically meets the disposal needs of its own administrative region.

By the end of 2025, a supervision system for hazardous waste with strict source prevention, strict process control and severe consequences shall be established and improved. The utilization and disposal capacity of hazardous waste is fully guaranteed, and the technology and operation level are further improved.

2、 Improve the supervision system and mechanism of hazardous waste

(4) All departments in each region shall implement the supervision and control responsibilities of hazardous waste according to the division of labor. The State shall formulate the guidelines and policies for the treatment of hazardous waste in an overall way, and the local people's governments at all levels shall take overall responsibility for the treatment of hazardous waste in the region. The relevant departments of development and reform, industry and information, ecological environment, emergency management, public security, transportation, health and health, housing and urban-rural construction, customs and other relevant departments shall implement their supervision responsibilities in the utilization and disposal of hazardous wastes, prevention and control of pollution environment, safe production, transportation safety and health and epidemic prevention. Strengthen coordination and communication among departments to form working forces( The Ministry of ecological environment, the national development and Reform Commission, the Ministry of industry and information technology, the Ministry of public security, the Ministry of housing and urban rural construction, the Ministry of transport, the State Health Commission, the Ministry of emergency response, the General Administration of customs and other departments and local people's governments at all levels are responsible for the implementation. (5) Establish joint prevention and control mechanism for environmental risk areas of hazardous waste. By the end of 2022, Beijing, Tianjin, Hebei, Yangtze River Delta, Pearl River Delta and Chengdu Chongqing regions will establish and improve cooperation mechanism, strengthen the sharing and linkage law enforcement of hazardous waste management information, and realize complementary advantages in the construction and operation management of hazardous waste centralized disposal facilities( Led by the Ministry of ecological environment, participated by the Ministry of public security and Ministry of transportation, etc.)

(6) Implement the responsibility of the enterprise subject. The main responsible person (legal representative and actual controller) of the enterprise (hereinafter referred to as the relevant enterprise of hazardous waste) of hazardous waste production, collection, storage, transportation, utilization and disposal (hereinafter referred to as the relevant enterprise of hazardous waste) is the first person responsible for the environmental prevention and safety production of hazardous waste, and strictly implement the laws and regulations on environmental prevention and control of hazardous waste pollution and safety production( The Ministry of ecological environment, the Ministry of public security, the Ministry of transportation and the Ministry of emergency shall be responsible for the division of responsibilities) the enterprises related to hazardous waste shall timely disclose the information on environmental prevention and control of hazardous waste pollution according to law, and shall take out the environmental pollution liability insurance according to the law( The Ministry of ecological environment and the CBRC shall be responsible for the division of responsibilities)

(7) Improve the information system of hazardous waste environmental management. Relying on the information engineering of ecological environment protection, the national hazardous waste environmental management information system is improved, and the online declaration of hazardous waste generation, online filing of management plan, online operation of transfer joint sheet, online report on utilization and disposal and online monitoring of the whole process are realized. Carry out the construction of online trading platform for collection, transportation, utilization and disposal of hazardous wastes and pilot payment by third parties. We encourage regions with conditions to implement integrated intelligent monitoring methods such as video monitoring and electronic labels, realize the tracking and management of the whole process of hazardous waste, and realize mutual sharing with relevant administrative and judicial organs( Led by the Ministry of ecological environment, participated by the national development and Reform Commission and the Ministry of Finance)

3、 Strengthen the control of hazardous waste source

(8) Improve the system of hazardous waste identification. The national list of hazardous wastes is revised dynamically, and the special link exemption management is implemented for the hazardous waste with small environmental risks, and a list of hazardous waste discharge management is established. By the end of 2021, the management measures for hazardous waste identification shall be formulated and issued to standardize the procedures for identification of hazardous wastes and the management requirements of the identification units( Led by the Ministry of ecological environment, participated by the national development and Reform Commission, the Ministry of public security and the Ministry of transport)

(9) Strict environmental access. The new reconstruction and expansion project shall carry out environmental impact assessment according to law, and strictly control the "Three Simultaneity" management of environmental prevention and control facilities caused by hazardous waste pollution. Review the approved environmental impact assessment documents of key industries related hazardous waste construction projects according to the law and regulations. The system of permit for discharge of industrial hazardous waste shall be implemented in accordance with law. Promote the standardized environmental management of hazardous waste( Responsible for)

(10) We will push forward the reduction of the source. 4、 Strengthen the supervision of the collection and transfer of hazardous waste

(11) Promote the specialization of collection, transfer and storage. We will further promote the classification of domestic waste and establish a collection and transfer system for hazardous waste( The Ministry of housing and urban rural construction takes the lead and relevant departments participate in) supports the construction of regional collection outlets and storage facilities by the specialized collection and transfer units of hazardous waste, and provides paid collection and transfer services for hazardous wastes generated by small and micro enterprises, scientific research institutions and schools. (12) Promote the convenience of transfer transportation. Establish the filing system of transport vehicles for hazardous wastes and medical wastes, improve the "point-to-point" regular route, and realize the standardized and orderly transportation vehicles of hazardous wastes and medical wastes, and ensure safe and convenient access( The Ministry of public security, the Ministry of ecological environment, the Ministry of transportation and the state health commission shall be responsible for the division of responsibilities) simplify the approval procedures for cross provincial transfer of hazardous waste in the form of "white list" according to the enterprise environmental credit records and the degree of environmental risk control. To maintain the fair competition market order of cross regional transfer of hazardous waste, unreasonable administrative barriers shall not be set up in all regions( Responsible for)

(13) We will crack down on the illegal and criminal acts involving hazardous waste. Strengthen the law enforcement of hazardous waste environment, and take it as an important content of comprehensive law enforcement of ecological environment protection. We will crack down on illegal environmental crimes such as illegal discharge, dumping, collection, storage, transfer, utilization and disposal of hazardous wastes, implement the system of compensation for ecological environmental damage, and strengthen the coordination and linkage between administrative law enforcement and criminal justice and public prosecution litigation( The Supreme People's court, the Supreme People's Procuratorate, the Ministry of public security and the Ministry of ecological environment shall be responsible for the division of responsibilities) shall be given light punishment according to law for enterprises who have self checked and corrected and disposed of the hazardous wastes left over by history in a timely manner( Led by the Supreme People's court and the Supreme People's Procuratorate, and participated by the Ministry of ecological environment)

5、 Strengthening supervision of waste hazardous chemicals

(14) Establish a regulatory linkage mechanism. Emergency management department, ecological environment department and other relevant departments shall establish supervision cooperation and joint law enforcement mechanism, closely coordinate and cooperate to realize timely, full and effective sharing of information, and form working forces( The Ministry of ecological environment and emergency response shall be responsible for the division of responsibilities)

6、 Improve the basic guarantee capacity of centralized disposal of hazardous wastes

(15) Strengthen the disposal capacity of special hazardous wastes. A number of utilization and disposal bases of hazardous wastes with great threat to environment and human health shall be constructed according to special categories, a batch of large-scale hazardous waste centralized incineration and disposal bases shall be built according to regional distribution, and a batch of hazardous waste landfills shall be built in appropriate areas according to geological characteristics to realize national or regional shared disposal capacity( The people's governments at the provincial level are responsible for the responsibilities of the national development and Reform Commission, the Ministry of finance, the Ministry of natural resources, the Ministry of ecological environment, the Ministry of housing and urban rural development, etc.)

(16) Promote the overall matching of the disposal capacity of hazardous waste and the situation of production and waste in the province. The people's governments at the provincial level shall carry out the assessment of matching the production and disposal capacity of hazardous wastes and the assessment of the operation of facilities, and scientifically formulate and implement the construction plan of centralized disposal facilities for hazardous wastes. By the end of 2022, the disposal capacity of hazardous waste in each province (autonomous region and municipality directly under the central government) will match the overall situation of production and waste( The people's governments at the provincial level are responsible for the responsibilities of the national development and Reform Commission, the Ministry of finance, the Ministry of natural resources, the Ministry of ecological environment, the Ministry of housing and urban rural development, etc.)

(17) Improve the capacity of medical waste disposal in the city. At least one centralized medical waste disposal facility meeting the operation requirements shall be built in cities at or above the local level as soon as possible. By the end of June 2022, the collection and transfer system of medical waste will be established in all counties (cities). We will encourage the development of mobile medical waste disposal facilities and provide local treatment services for remote grass-roots areas. 7、 Promote the high quality development of hazardous waste utilization and disposal industry

(18) Promote the large-scale development and professional operation of hazardous waste utilization and disposal enterprises. The ecological and environmental departments of the Municipal People's governments with districts regularly release relevant information on hazardous waste to scientifically guide the development of hazardous waste utilization and disposal industry. In principle, the disposal capacity of new centralized incineration facilities for hazardous waste should be more than 30000 tons / year, the direct landfill of hazardous waste that can be reduced by incineration should be controlled, and cement kilns should be moderately developed for collaborative disposal of hazardous waste. Implement the reform requirements of "discharge and management service", encourage the construction of large-scale hazardous waste utilization facilities by means of diversified investment and market-oriented; Encourage enterprises to expand and strengthen through merger and reorganization, carry out professional construction and operation services, and strive to build a number of first-class enterprises for hazardous waste utilization and disposal( The national development and Reform Commission and the Ministry of ecological environment shall be responsible for the division of responsibilities)

(19) Regulate the use of hazardous waste. Establish and improve the standard system for comprehensive utilization of solid waste, and the use of the products of comprehensive utilization of solid waste shall conform to the purposes and standards prescribed by the state( The State Development and Reform Commission, Ministry of industry and information technology, Ministry of ecological environment and Ministry of agriculture and rural areas, etc., led by the General Administration of market supervision, have explored the exemption management of "point-to-point" directional utilization license of hazardous waste under the premise of controllable environmental risks( Led by the Ministry of ecological environment, involving relevant departments)

(20) We will improve financial and financial policies. Improve the charging system for the disposal of hazardous waste and medical waste, formulate the charging standards for disposal and adjust them in time; On the premise of ensuring the whole process monitoring of hazardous waste and traceability of illegal and illegal behaviors, the charging standard for disposal can be determined by both parties through negotiation. Establish a system for the provision of decommissioning expenses for facilities and sites for centralized disposal of hazardous wastes, and the pre-mentioned expenses shall be included in the investment budget or operating costs. Implement the environmental protection tax policy. Financial institutions are encouraged to increase credit for projects for prevention and control of environmental pollution by hazardous wastes. (21) Accelerate the promotion and application of advanced and applicable technology achievements. The application technologies of hazardous waste such as waste acid, waste salt, fly ash from domestic waste incineration and environmental pollution prevention and treatment are studied and demonstrated. Establish and improve the evaluation system of environmental protection technology, strengthen the construction of national ecological and environmental technology achievements transformation platform, and promote the sharing and transformation of technical achievements of hazardous waste utilization and disposal. 8、 Establish emergency treatment system of medical waste combined with the war

(22) Improve the emergency treatment mechanism of medical waste and hazardous waste. The local people's governments at or above the county level shall incorporate the collection, storage, transportation and disposal of medical waste into the leading and commanding system of major infectious diseases, strengthen overall coordination and ensure the vehicles, sites, disposal facilities and protective materials required( The State Health Commission, the Ministry of ecological environment, the Ministry of housing and urban rural construction, the Ministry of transportation, etc. are responsible for the division of responsibilities) to incorporate the emergency treatment of the ecological environmental incidents involving hazardous wastes into the government emergency response system, improve the environmental emergency response plan, strengthen the construction of emergency capacity of hazardous waste environment, and ensure the emergency disposal of hazardous waste( Led by the Ministry of ecological environment, involving relevant departments)

(23) To ensure the emergency disposal capacity of medical waste in major epidemic situations. The company shall coordinate the resources of newly built, under construction and existing hazardous waste incineration and disposal facilities, cement kilns for collaborative disposal of solid waste, domestic waste incineration facilities, and establish a list of collaborative emergency treatment facilities. By the end of 2021, the Municipal People's governments of each district shall at least define one collaborative emergency disposal facility, and at the same time, the management process and rules of emergency state of the facilities. 9、 Strengthen the ability of environmental risk prevention and control of hazardous waste

(24) Strengthen the construction of professional supervision team. We will establish a hazardous waste supervision system that matches the needs of environmental risk prevention and control, strengthen the construction of national regulatory capacity for hazardous waste and technical support for emergency disposal, establish and improve the technical support system for national, provincial and municipal level hazardous waste environmental management, strengthen the comprehensive law enforcement team and capacity-building of ecological environment protection, strengthen the construction of professional talents, and allocate the strength of personnel, We will effectively improve the environmental supervision and risk prevention and control capabilities of hazardous waste( Led by the Ministry of ecological environment, and participated by the Central Committee)

(25) Improve the supporting laws and regulations. We will implement the newly revised law of the people's Republic of China on the prevention and control of environmental pollution by solid waste, improve the management system of hazardous waste business license and transfer, and revise the pollution control standards and specifications for hazardous waste storage, incineration and identification( Ministry of ecological environment, Ministry of transport, Ministry of public security, Ministry of justice, etc. shall be responsible according to their respective responsibilities)

(26) Enhance the ability of basic research. Strengthen the research and development deployment of hazardous waste risk prevention and control and utilization and disposal technology, and actively support relevant scientific research activities through existing channels. We will carry out research on the mechanism of hazardous waste environmental risk identification and control, strengthen the technical capacity building of regional hazardous waste and chemical testing and analysis and environmental risk prevention and control, and strengthen the support of hazardous waste environmental risk early warning and management decision-making( Ministry of science and technology, Ministry of ecological environment, etc. shall be responsible according to the division of responsibilities)

10、 Safeguard measures

(27) Local and departmental responsibilities. Local people's governments at all levels should strengthen the organization and leadership of strengthening the supervision, utilization and disposal capacity of hazardous waste. The local people's governments at or above the county level shall incorporate the prevention and control of environmental pollution by hazardous waste into their annual reports on the state of the environment and the achievement of environmental protection objectives, and report to the people's congresses or their standing committees at the corresponding levels. All relevant departments shall strictly perform the responsibilities of hazardous waste supervision according to the division of responsibilities, and strengthen the coordination and linkage of work. Those who fail to fulfill the regulatory responsibility of hazardous waste or fail to do so shall be seriously investigated for responsibility in accordance with the law( All relevant departments shall be responsible according to the division of responsibilities) establish the target responsibility system and assessment and evaluation system for the prevention and control of environmental pollution by hazardous waste, and take the completion of the target of prevention and control of environmental pollution by hazardous waste as an important reference for the assessment and evaluation of Party and government leading groups and relevant leading cadres( Led by the Ministry of ecological environment and participated by the Central Organization Department)

(28) Strengthen supervision. In the central and provincial eco-environmental protection supervision, we should strengthen the supervision on environmental pollution caused by hazardous waste. For places and units with frequent cases of environmental violations involving hazardous waste, serious insufficient disposal capacity and causing environmental pollution or adverse social impact, special supervision shall be carried out as appropriate to promote the rectification of problems. The clues of suspected violation of discipline or duty violation or duty crime found in the supervision shall be transferred to the discipline inspection and supervision organ in accordance with relevant regulations; For other problems, they shall be transferred to the supervised objects or relevant units for handling in accordance with relevant regulations( Led by the Ministry of ecological environment and participated by relevant departments)

(29) Strengthen education and training. Strengthen the construction of hazardous waste management related disciplines in universities and scientific research institutes. Strengthen the training of hazardous waste related employees, and build training practice base relying on qualified hazardous waste related enterprises. We will strengthen the implementation of the Basel Convention on the control of transboundary movements of hazardous wastes and their disposal, and actively carry out international cooperation and technical exchanges( Ministry of education, Ministry of ecological environment, Ministry of foreign affairs, etc. shall be responsible according to their respective responsibilities)

(30) Create a good atmosphere. Strengthen the publicity of the investigation and handling of major environmental cases involving hazardous wastes to form a strong deterrent. Promote the opening of hazardous waste utilization and disposal facilities to the public, and strive to resolve the "NIMBY effect". A reward reporting system will be established to include reporting on illegal transfer and dumping of hazardous waste in the scope of key rewards( Led by the Central Propaganda Department and the Ministry of ecological environment, with the participation of the national development and Reform Commission, the Ministry of public security, the Ministry of finance, etc.)
